ANAMBRA STATE DISABILITY RIGHT BILL , PASSED INTO LAW.

The Law provides for full integration of persons with disabilities into the society and prohibits all forms of discrimination against persons with disabilities.
The Law established a Commission known as "Anambra State Disabilities Right Commission".
The functions of the Commission include the following among others, namely:
1. Manage the affairs of persons living with disabilities.
2. Make policies and regulations for effective running of the Commission.
3. Screen and recommend persons with disabilities for employment into the State Civil Service.
4. Implement Government Policies with respect to the rights of persons living with disabilities.
5. Issuance of directives and guidelines for the education, social development and welfare of persons living with disabilities.
6. Receipt of complaints from persons living with disabilities concerning violation of their rights
7. Investigation and prosecution of violation of any provisions of this law.
8. Reorientation and education of the public on the right attitude towards persons living with disabilities.
9. Collection of data of persons with disabilities.
10. Award of scholarships to deserving persons living with disabilities.
11. Establishment and promotion of schools, recreational and rehabilitation centers for the development of persons with disabilities.
12. Liaising with ministries and government agencies and international bodies to ensure that interest of persons with disabilities are taken into consideration at all times in policy formulation and implementation.
13. Ensure compliance with the provisions of this Law.
Some of the provisions of the law include:
1. Persons living with disabilities shall not be discriminated against on the grounds of his disability by any person or institution in any manner or circumstances. Violation of this provision by a corporate body upon conviction attracts a minimum damages in sum of #250, 000.00 payable to the affect person with disability; while in the case of violation by individual, a nominal damages of #100, 000.00 payable to the person with disability or a three months imprisonment of both.
2. No person with disability shall be subjected to torture, cruelty or inhuman or degrading treatment; and no person shall employ, use or involve a person with disability for alms begging. Any contravention of this provision upon conviction attracts a fine of #100, 000.00 or three months imprisonment or both.
3. Government shall provide social security for persons living with disabilities that are 60years and above.
4. All levels of Government shall ensure that adequate provisions shall be made for persons with disabilities in employment, public facilities, public transport, parking lots, and public places to accommodate and protect their interests at all times.
5. No child with disabilities shall be concealed, abandoned or segregated on that basis. Children with disabilities shall be registered immediately with the commission after birth. Government through the Commission shall undertake to provide early and comprehensive information and support to children with disabilities and their families.
6. Government shall where the immediate family is unable to provide the need of the child with disability, provide and sponsor alternative care for the child.
7. In all matters concerning a child living with disability, the best interest of the child shall be the primary consideration.
8. Any person without any disability who deceptively disguise himself as a person with disability or use a fake condition of disability as a guise for the purposes of begging commits and offence and upon conviction shall be liable to a term of one year imprisonment or to a fine of #20, 000.00.
9. Every person with disability shall obtain a Certificate of Disability from the Commission.
10. Government shall ensure that Persons with disabilities shall be entitled to adequate and quality health care and health insurance scheme of the state without any cost.
11. Government shall establish special model schools for persons with disabilities in the State.
12. No person shall for comic effect mimic or ridicule individual or group with disabilities. No media outfit be it electronic, print or any other shall carry or transmit to the public for the purposes of entertainment or comic effect or ridicule of any form of disability. Any contravention of this provision by an individual upon conviction attracts a fine of #50, 000.00 and apology to the affected person or group; while in the case of a corporate body, a fine of #200,000.00 and an apology to the affected person or group.
